redlyst, LLC (“redlyst”, “us”, “we” and the like) respects your privacy and is committed to protecting it at all times. This online privacy statement explains how redlyst collects, uses, and safeguards information on its website (the “Site”). This Privacy Policy applies only to information collected by redlyst through its Site relating to you or any potential persons of interest to you (your “POIs”).

Purpose.  The purpose of this Privacy Policy is to inform you about the types of information we gather about you, including information gathered when you visit the Site, and information we may receive from third parties or affiliates in addition to that online information, how we may use that information, whether we disclose that information to anyone, and the choices you have regarding our use of, and your ability to correct, the information. redlyst strives to help visitors of the Site protect their privacy while using our Site.

This Privacy Policy is governed by the Terms of Use of our Site (“Terms of Use”). Please read our Terms of Use prior to using our Site or using, registering for, or purchasing any of our Services. Terms used in this Privacy Policy which are not defined in this Privacy Policy will have the meaning ascribed to such terms in our Terms of Use.  Any capitalized terms used in this Privacy Policy and not otherwise defined shall have the meaning assigned to them in the Terms of Use.

When you browse and do not interact with the Site for any online Service or product from redlyst, you browse anonymously. Personally identifiable information--such as your name, address, phone number and email address--is not collected as you browse.

When you become a registered Owner or User on our Site or choose to interact with our Site in other ways, such as purchasing any of our Services or products, using any or our Services, submitting questions or comments, or requesting information or materials, we will collect certain personal information from you regarding yourself or your POIs. The type of personal information collected will vary but may include names, email addresses, postal addresses, ZIP codes, social security numbers, driver’s license numbers, prior addresses, employers, job titles, income, telephone numbers, credit card information, bank account information and routing numbers, dates of birth, gender, age, marital status, user names and passwords, emergency contact information, criminal history, habits, information about unique interests or activities, information about vehicles including license plate numbers, and other personally identifiable information that is not otherwise publicly available which we deem desirable or necessary to provide quality services to our customers and visitors. Personal information also includes your usage of the Site, when such information is supplied to or recorded by us in the course of transacting business with you or your use of the Site. 

A subset of the overall information we collect is the following limited information regarding your POIs (“Limited POI Information”) which may be shared by you to other Users of the Site as described in the section below titled “How We or You May Share Information “: the POI’s facial representation, the POI’s profile picture, the POI’s name, height, weight, age, recorded behavior patterns, threat level, locations, activity level, etc.

You may choose not to provide your personally identifiable information by not entering it on the Site; however you will not be able to use certain services and features if those services and features require personally identifiable information in order to function.


4. How We Collect Information

We may collect information in several ways by your use of this Site, as well as from forms you submit to us, personal correspondence, such as emails or texts that you send to us, information you include in an application you complete on the Site, or any other activity through which you identify yourself to us. When you visit the Site, our servers may log your IP address, the URL of your request and other information that is provided in the HTTP header. We may also ask you to voluntarily provide us with personal information on this Site regarding yourself or any of your POIs. Although you may decline to voluntarily provide personally identifiable information when asked, some features, products and services will be unavailable to you as a result.

We use “cookies” on our Site. Cookies are pieces of information that an internet website transfers to your hard drive for record-keeping purposes. The use of cookies is an industry standard and frequently used by many websites. We use cookies to recognize visitors when they return to our Site. Through our use of cookies, we can customize and improve your use of our Site.

We may also evaluate our content and Services and tailor our Site for visitors based on other information we collect, such as IP addresses, which are numbers assigned to your computer whenever you use the internet, pixel tags (or clear gifs), and the type of internet browser or operating system you are using.   • Provide access to your personal information and your POIs to other registered Users 

  • Understand and anticipate your needs and preferences

  • Protect the security and integrity of our Site

  • Confirm your compliance with the Terms of Use, this Privacy Policy, and any other Contract

  • Conduct internal reviews of our Site and the Services we provide

  • Develop, enhance, and market our Services

  • Notify you about new products/services special offers, upgrades, and other related information from redlyst and other approved third parties

7. When We Disclose Information

We disclose personal information in the following circumstances:

  • Personal information may be shared with third party service providers compiling information on our behalf to help us improve our Site and the Services we provide you. For example, the handling of data processing or storage, surveys, research, credit card billing, ACH and similar transaction processing, internal marketing, delivery of promotional and transaction materials, and Site development, hosting, maintenance, and security. We do not authorize third parties to use your personal information in any manner, except to provide services for us.

  • Personal information may be shared with a third-party service provider to evaluate a registered user’s credit worthiness or to collect on a registered user’s account.

  • Personal information may be disclosed if required by law or ordered by a court or administrative agency.

  • Personal information may be disclosed to enforce the Terms of Use, this Privacy Policy, any Other Contracts, or to enforce or protect our rights.

  • We reserve the right to sell, transfer, and/or license the personal information you provide us to one or more third parties in the event we sell all or substantially all of the assets or equity of redlyst.

8. How We or You May Share Information

Except as set forth in this Privacy Policy or as specifically agreed to by you, we will not share or disclose any information about you or your POIs that we may gather from you on our Site.  However, many key aspects and functionalities of the Site depend upon Owners and Users voluntarily sharing information about their POIs to other Owners and Users.  You may share your personal information, via the following ways on our Site and via our Services:

  • We may share Limited POI Information with respect to your POIs to other Owners and Users if consented to you in advanced.   

  • This Limited POI Information (specifically the facial representation of your POIs) will assist other Owners and Users to identify your POIs through the use of the other Owners’ and Users’ Hardware.  

  • When such other Owners’ or User’s Hardware identifies one of your POIs, we may share with such other Owners and Users additional information held in the Limited POI Information related to the identified POI.

9. Changes to Privacy Policy

redlyst may amend this Privacy Policy from time to time. Should the Privacy Policy be modified in any way, the new Privacy Policy will be posted to this webpage. As we may make changes from time to time without notifying you, we suggest that you periodically review the Privacy Policy. By using the Site after the effective date of any modification to the Privacy Policy, you expressly consent, without qualification, to the collection, use and disclosure of information, including personally identifiable information (that you previously provided or later provide), as described in the new Privacy Policy.

10. Information Security

redlyst implements security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. We restrict access to personal information to redlyst’s business partners who may need to know that information in order to operate, develop, or improve our Services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

11. How We Store and Protect Personal Information

We store, process, and protect personal information we collect by maintaining physical, electronic, and procedural safeguards in compliance with applicable U.S. federal and state regulations. In certain areas of our Site, we use industry-standard SSL-encryption to protect data transmissions and we use industry standard practices to protect your privacy and the personal information we collect from you; however, we cannot ensure that your private communications and personal information will only be disclosed as described in this Privacy Policy. In the unlikely event that an unauthorized third party compromises our security measures, we will not be responsible for any damages directly or indirectly caused by an unauthorized third party’s ability to view, use, or disclose such information. Also, administrative agencies or courts of competent jurisdiction may order the disclosure of the personal information we collect. Therefore, we cannot guarantee, and you should not expect the personal information you provide us will always remain private. From time to time, following your termination of a Service, we may delete and destroy personal information we have collected from you.

You should be aware that other internet sites that link to redlyst’s site or to a redlyst email may contain privacy provisions that differ from the provisions of this Privacy Policy. To the extent required by applicable law, you may request that we inform you about the personal information we maintain about you or your POIs, and where appropriate, request that we update, correct, and/or suppress personal information about you or your POIs that we maintain in our active database. We will make all required updates and changes within the time specified by applicable law, and where permitted, may charge an appropriate fee to cover the costs of responding to such request. Please remember, if you make such a request, we may not be able to provide you with the same quality and variety of services to which you are accustomed.
